Webjunk.net Policies and Procedures
In order
to establish a fair environment for all Webjunk.net customers,
we've laid out a few simple ground rules.
Privacy
Personal/confidential
information (credit card numbers, e-mail addresses, contact information,
etc.) will be used exclusively for the expressed reasons we specify
when gathering it. It is Webjunk.net's policy not to share,
sell, or otherwise distribute this information to any unauthorized
third party.
Usage
Webjunk.net is an Internet Presence Provider
(IPP). We host web pages and provide e-mail services. Webjunk.net has certain
legal and ethical responsibilities regarding the use of its computer
network and equipment. Our goal to be unbiased in providing hosting
services for the World Wide Web (www) however, Webjunk.net reserves the
right to cancel or interrupt any client's access to our services
if we believe the account is being abused. You are solely and fully
responsible for any content in the space provided for your web page.
Unsolicited
Bulk E-mail (UBE)
Any unsolicited UBE is considered spamming and may
result in your account suspension or cancellation. Spamming or UBE
is frowned upon in the industry and in most cases and is considered
unethical. E-mail is meant to be person-to-person or one party to
an agreeable second party.
Traffic
and Storage / Archiving, Storage of Files
The space
provided by Webjunk.net is to be comprised of hypertext markup language
(html) and associated files intended solely for the presentation
of the customer's web pages. Webjunk.net defines archiving as the storage
of files on our server(s) that are not linked or related to the
purpose of the web page. Violation can result in warning, suspension,
or cancellation.
Copyrighted
Material
Webjunk.net prohibits the distribution of copyrighted materials.
This includes Warez software and the music compression format, Mp3.
Warez is defined by webjunk.net as illegal/pirated software. If a site is
found to distribute or archive copyrighted or Warez material, Webjunk.net
reserves the right to terminate service for that domain. Webjunk.net also
prohibits any sites with direct links to other sites containing
such material.
Adult
Material
Adult material is defined by Webjunk.net as any photos or
videos showing frontal nudity of either men or women. Any photos
or videos showing women's bare chests and nipples, or any audio
clips or text containing sexually explicit material. Adult material
also consists of the sale of sexually explicit materials. Webjunk.net also
reserves the right to determine what might be considered "sexually
explicit" or "sexually related". Webjunk.net also prohibits any sites with
direct links to other sites containing such material.
Tape
Backup
Although Webjunk.net runs daily back-ups of your website, you
are ultimately responsible to maintain a current copy of your site
other than the one on our server hard drives.
Cancellation
Cancellation may occur at any time and be invoked
by the customer or Webjunk.net. We reserve the right to cancel hosting services
at any time. If cancellation is due to your abuse of our policies,
there will be no refund. Any cancellation by the customer must be
in writing and sent to Webmaster@webjunk.net.
Payment
Pre-payment
is required on all accounts. All fees are guaranteed for the payment
period once received. Credit card orders will be charged automatically
to the card number on file, unless otherwise notified. If the card
does not clear, you will be notified and subject to suspension.
Returned checks will be assessed a $15.00 charge. All accounts are
paid in U.S. dollars. Webjunk.net must be notified in writing
to request termination of services.
All refunds are granted - no questions asked.
Legalese
Webjunk.net requires all use by customers be
for lawful purpose only. We reserve the right to refuse service
at any time to anyone for any reason. Use of Webjunk.net servers or bandwidth
in violation of any Federal, State, or Local statute, law or regulation
is prohibited and constitutes grounds for cancellation. Webjunk.net does
not allow sub-hosting of any kind. Customers cannot sublease, subhost,
or give away control of any portion of Webjunk.net resources.
Indemnification
Customer agrees that it shall defend, indemnify,
save and hold Webjunk.net harmless from any and all demands, liabilities,
losses, costs, and claims, including reasonable attorney fees asserted
against Webjunk.net, its agents, its customers, officers, and employees,
that may arise or result from any service provided or performed,
or agreed to be performed or any product sold by customer, its agents,
employees or assigns. Customer agrees to defend, indemnify and hold
harmless Webjunk.net against liabilities arising out of: (1) any injury
to person or property caused by any products sold or otherwise distributed
in connection with Webjunk.net's server(s); (2) any material supplied by
customer infringing or allegedly infringing on proprietary rights
of a third party; (3) copyright infringement and (4) any defective
products sold to customer from Webjunk.net's server(s).
Disclaimer
Webjunk.net will not be responsible for any damages your
business may suffer. Webjunk.net makes no warranties of any kind, expressed
or implied for the services we provide. Webjunk.net disclaims any warranty
or merchantability or fitness for a particular purpose. This includes
loss of data resulting from delays, non-deliveries, wrong delivery,
and all service interruptions caused by Webjunk.net and its employees. Webjunk.net
reserves the right to revise its policies at any time. If your site
contains material that you are unsure about, please let us know
